EU Data Act Compliance
EU Data Act Compliance
Transparency, Fairness, and Control over your Energy Data.
Overview of the EU Data Act
The EU Data Act (Regulation (EU) 2023/2854) is a landmark regulation aimed at ensuring a fair allocation of the value of data among actors in the data economy. It harmonizes rules on access to data generated by connected products and related services.
Zendure is committed to full compliance with Regulation (EU) 2023/2854 and Zendure's Privacy Policy, ensuring that users of our connected energy storage systems have control over their data while protecting intellectual property and ensuring system security.
Scope & Applicability Article 1 & 2
The Data Act applies to "connected products" (Internet of Things / IoT devices) and "related services". This includes all Zendure smart energy devices sold within the European Union, such as:
- SolarFlow (PV Hubs and Batteries)
- SuperBase V and other Home Energy Storage Systems
- Satellite Batteries
- Smart Plugs & Meters connected to the Zendure ecosystem
Who is covered?
Both Business Users (B2B) and Consumers (B2C) who own, rent, or lease a connected Zendure product are entitled to the rights described below.
Your Rights Under the Data Act
1. Access by Design Article 3
Zendure designs its connected products so that the data generated by their use is, by default, easily, securely, and, where relevant and appropriate, directly accessible to the user.
2. Right to Access and Use Data Article 4
Where data cannot be directly accessed from the product itself, Zendure shall make available to the user the data generated by its use of a connected product or a related service without undue delay, free of charge, and, where applicable, continuously and in real-time.
3. Right to Share with Third Parties Article 5
Upon your request, Zendure will make available the data generated by the use of a connected product to a third party (e.g., an aftermarket service provider, energy aggregator, or insurance company) without undue delay and free of charge to the user.
Note: We are not required to share data with "Gatekeepers" designated under the Digital Markets Act (Regulation (EU) 2022/1925).
Protection of Trade Secrets Article 8
While we are committed to transparency, we must also protect our intellectual property. Under Article 8 of the Data Act:
- Trade secrets shall be preserved and disclosed only if strictly necessary to fulfill the purpose agreed upon.
- Zendure and the data recipient (third party) may agree on technical and organizational measures to preserve the confidentiality of shared data.
- If a user or third party fails to respect these confidentiality measures, Zendure reserves the right to suspend data sharing.
B2G Data Sharing in Public Emergencies Article 14-22
In exceptional circumstances of public emergency (e.g., natural disasters, public health emergencies), Zendure may be legally obliged to make certain data available to public sector bodies or EU institutions upon their reasoned request, strictly for the purpose of responding to that emergency.

Data Holder & Usage Information
Who is the Data Holder?
Zendure acts as the Data Holder for all data generated by your connected energy devices. We are responsible for the secure storage and management of this data.
- Entity Name Zendure
- Contact Email privacy@zendure.com
- Role Data Holder & Processor
How We Use Your Data
Zendure processes device data primarily to ensure the functionality and optimization of your energy system. Key usage purposes include:
- Device Operation: Monitoring real-time status (SOC, power flow) to enable App control.
- System Optimization: Analyzing historical generation and consumption to optimize energy distribution algorithms (e.g., SolarFlow intelligent control).
- Firmware Improvement: Using aggregated performance data to identify bugs and roll out over-the-air (OTA) updates.
- Customer Support: Accessing device logs (upon request) to diagnose and resolve technical issues.
How We Manage & Protect Data
We adhere to strict data governance policies to protect your information:
- Security Measures: Data is encrypted in transit (TLS 1.2+) and at rest (AES-256) on AWS servers.
- Access Control: Internal access to user data is restricted to authorized engineering and support staff via strict Role-Based Access Control (RBAC).
- Third-Party Sharing: We do not share your raw data with third parties unless you explicitly authorize it (e.g., linking to a smart home platform) or are legally required to do so.
Switching & Interoperability Article 23-31
To prevent vendor lock-in and ensure a competitive cloud market, Zendure supports:
- Functional Equivalence: You can switch to alternative data processing services while maintaining functional equivalence where feasible.
- No Switching Charges: Effective from January 12, 2027, Zendure will not charge any switching charges for the transition to another provider.
- Interoperability Standards: Our devices support common communication protocols (e.g., MQTT, HTTP API) to ensure seamless integration with other ecosystems (Article 28).
Dispute Settlement Article 10
If you believe your rights under the Data Act have been infringed, you have the right to lodge a complaint with the competent national authority. Additionally, disputes regarding data access and sharing conditions may be referred to certified dispute settlement bodies.
